Overview

Welcome to Been There. Been There is a community platform operated by No.3 ("Been There," "No.3," "we," "us," or "our") where people can share personal experiences and connect with others who may have gone through something similar. By creating an account, accessing, or using Been There, you agree to these Terms of Use. If you do not agree, please do not use the service.

1. What Been There Is

Been There is built around a simple idea: Sometimes you don't need an answer. You just need to know someone else has been there. Members may share experiences, respond to stories, indicate that they have experienced something similar, share what helped them, and provide updates about their journeys. Been There is a community platform. It is not a medical, mental-health, legal, financial, emergency, counseling, or other professional service.

2. Eligibility

You must be at least 18 years old to create an account or post on Been There during this beta. By creating an account, you confirm that you meet this requirement and are legally capable of agreeing to these Terms. We may revise eligibility requirements as the service evolves.

3. Your Account

You are responsible for maintaining the security of your account and credentials. You agree not to: • impersonate another person; • create accounts for fraudulent, abusive, or deceptive purposes; • sell or transfer your account; • evade a suspension, restriction, or ban by creating another account; or • access another person's account without permission. Although Been There is designed to allow pseudonymous participation, pseudonymity does not give anyone permission to misuse the service.

4. Keep It Anonymous

Been There is designed to minimize unnecessary personal identification. When posting, avoid sharing information such as: • full names; • phone numbers; • personal email addresses; • home addresses; • account or identification numbers; • exact workplaces where unnecessary; • financial credentials; • passwords; • medical record identifiers; or • information that could unnecessarily identify another person. Our systems may detect or block certain types of personal information before publication. These safeguards are not perfect. You remain responsible for reviewing what you share.

5. Your Content

You retain ownership of content you create and submit to Been There. By submitting content, you grant No.3 a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, process, and distribute that content only as reasonably necessary to operate, secure, moderate, improve, and provide Been There. This license ends when your content is deleted, except where limited retention is reasonably necessary for backups, legal obligations, security, fraud prevention, moderation records, dispute resolution, or other legitimate purposes described in our Privacy Policy. You represent that you have the right to share the content you submit. Do not post another person's private story, confidential information, photographs, identifying details, or other content unless you have the appropriate right or permission to do so.

6. You Are Responsible for What You Share

Users are responsible for their own stories, replies, advice, reactions, and other submissions. User-generated content does not represent the views of No.3 or Been There. We do not routinely verify whether: • a story is factually accurate; • someone actually experienced what they claim; • advice is correct; • a person clicking "Been There" has actually had the same experience; or • a "Made It Through" response represents a verified outcome. Use reasonable judgment when interacting with community content.

7. Peer Experiences Are Not Professional Advice

Content on Been There reflects personal experiences and perspectives. It should not be treated as a substitute for professional advice. This includes medical, psychological, legal, financial, employment, safety, and other professional advice. A person's experience may be useful to hear while still being inappropriate for your particular circumstances. You are responsible for decisions you make based on information encountered through Been There.

8. Emergencies

Been There is not an emergency response service and is not continuously monitored for emergencies. If you or another person is in immediate danger, contact the appropriate local emergency service or seek qualified assistance. A post, reply, report, or other submission to Been There should not be relied upon as a request for emergency assistance.

9. Community Conduct

By participating in Been There, you agree to follow our Community Guidelines. Among other things, you may not use Been There to: • harass, threaten, intimidate, or bully; • promote hatred or discrimination; • exploit or sexually target another person; • encourage serious harm; • perpetrate fraud or scams; • impersonate others; • publish another person's private information; • spam the community; • manipulate community interactions; • coordinate abuse; • distribute malware or malicious content; • solicit money or payments; • promote unauthorized fundraising; • sell commercial services through community posts; • attempt to move users off-platform for suspicious or exploitative purposes; or • engage in unlawful activity.

10. No Solicitation During Beta

During the initial version of Been There, users may not use stories or replies primarily to request money, goods, services, donations, direct transfers, or other material benefits. Likewise, users may not use Been There to solicit customers or promote commercial services without our permission. If practical support or gifting is introduced later, separate rules may apply.

11. Moderation

We want people to be able to speak honestly while keeping the community safe. We may review, restrict, hide, remove, preserve, or restore content when reasonably necessary. We may also warn, restrict, suspend, or terminate accounts. Moderation decisions may consider: • these Terms; • Community Guidelines; • user reports; • context; • repeated behavior; • platform security; • applicable law; and • risks to users or the service. We are not obligated to publish or continue hosting every submission. We may preserve certain removed content or related records for a limited period where reasonably necessary for moderation, safety, legal compliance, fraud prevention, or dispute handling.

12. Reporting

Users can report stories and replies they believe violate our rules. Reports should be made in good faith. Do not intentionally submit false or abusive reports to target another user. Submitting a report does not guarantee a particular moderation outcome.

13. Platform Safety

We may use automated and manual systems to detect spam, personal information, abuse, potentially dangerous content, suspicious activity, or other violations. Automated systems can make mistakes. Where appropriate, flagged content may be reviewed or acted upon by authorized administrators.

14. Intellectual Property

The Been There name, branding, interface, software, designs, and other materials created by No.3 are owned by or licensed to No.3 and are protected by applicable intellectual-property laws. These Terms do not grant you ownership of the Been There platform or brand.

15. Service Availability

Been There is currently an evolving product and may be offered as a beta. Features may change, break, be removed, or become temporarily unavailable. We may modify, suspend, or discontinue parts of the service as the product develops. We will make reasonable efforts to operate the service responsibly but do not guarantee uninterrupted or error-free availability.

16. Third-Party Services

Been There may rely on third-party infrastructure and service providers for functions such as authentication, hosting, storage, email, analytics, security, and other technical operations. Use of those services may be subject to their respective terms and privacy practices where applicable. Our Privacy Policy explains how personal data may be processed through service providers.

17. Account Restriction or Termination

We may restrict, suspend, or terminate access when reasonably necessary because of: • serious or repeated rule violations; • fraud; • harassment; • attempts to compromise platform security; • attempts to evade moderation; • unlawful activity; or • risks to users or the platform. Where appropriate, less severe measures may be used before termination.

18. Leaving Been There

You may stop using Been There at any time. Account deletion is available through the account settings. Deletion and retention of associated data are handled according to our Privacy Policy and applicable law.

19. Disclaimers

To the extent permitted by applicable law, Been There is provided on an "as is" and "as available" basis. We do not guarantee that: • user content is accurate; • advice will be appropriate; • another user is who they claim to be; • all harmful content will be detected immediately; • the service will always be available; or • participation will produce a particular personal outcome. Nothing in these Terms excludes rights or responsibilities that cannot lawfully be excluded.

20. Limitation of Liability

To the maximum extent permitted by applicable law, No.3 and its authorized representatives will not be liable for indirect, incidental, special, consequential, or similar damages arising from use of the service, user-generated content, interactions with other users, or inability to access the service. This provision does not exclude liability that cannot legally be excluded or limited.

21. Indemnity

To the extent permitted by law, you agree to be responsible for losses, claims, or liabilities arising from your unlawful use of Been There, your violation of these Terms, or content you submit that violates another person's rights.

22. Privacy

Our Privacy Policy explains how we collect, use, disclose, retain, secure, and delete personal data. By using Been There, you acknowledge that you have had an opportunity to review the Privacy Policy.

23. Changes to These Terms

We may update these Terms as Been There evolves. Each published version will have a version number and effective date. If we make a material change that requires renewed acceptance, we may ask you to accept the updated Terms before continuing to use relevant portions of the service. Previous versions may be retained for compliance and recordkeeping purposes.

24. Governing Law

These Terms are governed by the laws of the Republic of the Philippines, without prejudice to any mandatory rights or remedies available under applicable law.
